SM Entertainment revealed their stand for their discord with trio Hero JaeJoong, Xiah JunSu and Micky YooChun of group Dong Bang Shin Ki through reports on 13th november.
SM Entertainment said, “We gave the deadline for the 3 members to give us a reply about Dong Bang Shin Ki’s comeback in Korea next year by 12th November previously during our press conference on 2nd November. But we did not get any response. This has hence make the group’s comeback in Korea next year impossible.”
SM Entertainment also added, “The trio has agreed to carry out the schedule planned on basis of the basic contract between the company and the group before the court during the time when the trial was on going. But after part of the trial judgement came out, the trio said they will not participate or the coming concert performance on 21st November in Chin which is part of their Asian concert tour performances decided as of June 2008, and for subsequent concert performance, they have stated that they may not be participating for them.”

It was revealed that TVXQ’s Hero Jaejoong and Taegoon recently
went on a trip and spent 1 night and 2 days together in Busan.
The two stars spent 2 days from November 7 to November 8 together in Busan, both having a break for the first time in some time. Residents of Busan said they’d seen the two together at the local sea food market in Busan, and eating and resting together.
Both Taegoon and Jaejoong were born in January 1986 and grew up in the same hometown. Until now they have maintained a fantastic friendship.
Jaejoong had previously appeared in Taegoon’s debut MV Call Me earlier this year after Jaejoong’s long attempts to convince SM to let him appear in the video.
Meanwhile, Taegoon is enjoying popularity in Japan as he held a successful fanmeet in July, two events in November at Sanrio Puroland and a famous live house, and his first solo concert planned for December at Tokyo’s Nanako Zero Hall.
Taegoon is currently busy with activities for his 3rd minialbum, while Jaejoong’s kiss scene in Heaven’s Postman is collecting interest.[credits]TG @

The possibility of Korea's top idol group TVXQ disbanding is increasing, after their agency sent an apparent ultimatum to three of the five-member boy band to return to the agency.
Speaking at a press conference on Monday, SM Entertainment chief Kim Young-min accused the three members -- Xiah , Hero , and Micky -- of having sued against the company out of greed to make more money.
Kim was speaking about the ongoing legal battle between the three members and the company. The three band members claim the contract signed between TVXQ and the management agency is unfair.
Last month, a lower court sided with the three and ruled that parts of the contract should be invalidated, paving the way for them to resume individual music and advertisement careers.
The agency vowed to bring the case to a higher court, saying the three must follow the contract as long as they continue to be part of TVXQ, and should get paid according to the current contract.
The other two members -- U-know and Max -- rendered their support for the management agency's claim, expressing hope that the other three would return quickly.
In their statement, the two stressed that all members have worked under the same contract with SM Entertainment for the past five years.
"We believe that TVXQ would not have been in existence without SM Entertainment, which created the group. We are also not willing to resume our career as TVXQ without our current agency," the statement said.
In a related movement, SM Entertainment chief Kim made it clear that although the court granted freedom to the three members to pursue individual activities, they are allowed to work as TVXQ only under SM.
The company demanded that the three members reply to its request to return to the agency by Nov. 12.

Members of the Korean Cassiopeia, TVXQ/DBSK's official fanclub, have released their official statement regarding SM Entertainment's press conference regarding legal dispute involving DBSK which took place yesterday(02.11.). Here is the translated version of their statement:
We 800,000 Cassiopeians would like to announce our official view in this statement. With accusations and allegations flying everywhere, we announce this in order to show the fanclub's official standing on this matter. This statement is made by union of numerous DBSK fan cafes and we present this in the name of Cassiopeia.
First of all, we would like to say that, as fans of DBSK, we support DBSK and will not do anything to betray their trust in us. We will not trust anything besides words that come out of the DBSK members' mouths, and we ask SME to stop actions that are intended to confuse and divide the fans.
We Cassiopeians are very disappointed in SME for holding press conference and releasing signed documents in the name of Yunho and Changmin. As the management company of DBSK, SME must not forget their job and must stop their actions intended to defame the members of DBSK and break the group apart. Also, according the the court ruling made on the 27th, SME must not make deals with third parties in the name of the three members and cannot interfere with individual works or those members. Please keep the court's order.
To everyone who is reading this statement, please remember: the members did not take legal actions because of the issues regarding the cosmetics business. They started this lawsuit because of illegal contract length of 13 years. We fans do not understand why SME is silent about the issue of the contract length and is trying to focus everyone's attention on the cosmetics fiasco. The goal of this lawsuit was to nullify or edit contract between SME and the three members, and we believe that they did not intend to end DBSK or move onto another management company. Also, we would like to address to reporters who sensationalize and create rumours related to this press conference. Please be careful with your sources.
We would like to ask SME one more time to not make the three members' reputation and rights suffer with claims that have never been proven, and we would like to ask the citizens of Korea to stop creating rumours and defame DBSK. We would like to show our condolences toward this controversy.

With the court agreeing on the injunction sent by the 3 members of TVXQ, the trio had the power to look at SM Entertainment's contract for the members. It was shockingly unfair and against public policy. The three members who stood up for themselves (Kim Junsu, Kim Jaejoong, and Park Yoochun) have the court on their side and are now proceeding with their main lawsuit, which is to get the shares and income that they deserve from their activities in the past 6 years.
Below is what the court has presented as the content of the members' contracts. The contract has been modified 5 times since their debut, so this is the overall review.
1. TVXQ has received $0 from their album sales till July 2008, and a very small amount after.
Before the fifth modification that the company made with their contract, it stated that the profit from albums and singles with sales less than 500,000 copies would go 100% to SM Entertainment, which left the members with nothing. There has been no Korean album that have exceeded 500,000 album sales between the time of TVXQ's debut and their 4th album Mirotic, which was the first album in Korea to sell over 500,000 albums for a long time.
On July 1 2008, the company changed the contract so each member would get 1% from album sales that exceeded 200,000 copies. For albums that are below that number, they are paid 0.6% to nothing. Through these terms, TVXQ has not earned a single cent since February 2009.
2. TVXQ has received $0 from sales of concert DVD's and albums with recordings from concerts.
The contract stated that the members are not entitled to get any profit from concert DVD's and "live" albums.
3. TVXQ received $0 from their appearances in TV programs.
In the contract, the members do not have a right to receive the shares made from appearances on television programs if they are featured in only one episode or if their appearance is temporary. SM has kept all the profit from TV shows where TVXQ were guests.
4. For other ways of getting profit, SM subtracts the total amount with all the expenses that the company has paid for them, including clothing, salary of company staff, stage preparation, rent, food expenses, and etc., which only leaves a fraction for the members of TVXQ.
As for all other sources of income, the contract says that the members do not get the full "net income", but only get a percentage of it. The contract states that the "net income" is the profit remaining after deducting their operating costs, which is the money that the company spends on them. The operating costs include expenses that are to be covered by the employer, such as salaries of the staff (manager, clothing coordinators, makeup artists, dance coordinators, back dancers, etc.), performance stages, living expenses which include water and electricity bills, travel expenses which include plane tickets, and meal expenses. The company might add something in addition to deduct more from the net income.
In conclusion, TVXQ actually received anywhere from 1% to 5% from all of their activities, which depending on how you look at it can still add up to 7 figures or more but still many consider this to be unfair.[credits](source: xaosmx @
